Terms and Conditions
Commercial Terms and Conditions of attendance at Giggle and More Ltd
General
1.The terms and conditions set out the contract between Giggles and More Ltd and the Parent or legal Guardian ( as identified overleaf and referred to as the “Parent”) with respect to your child (or children)’s attendance at Giggles and More Breakfast and Afterschool Club. It has been set out in the enrollment details on the front page of this documentation or online registration.
- These terms and conditions should be read in concurrence with the enrollment details. It is done in the event of any inconsistency between the terms and conditions and the enrollment details.
- Giggles and More is a private limited company with company registration number SC799553 and glistered office at 8 Deer park, fairway Business Park, Livingston, EH54 8GA, with contact email contact@gigglesandmore.co.uk. It operates from Dechmont Community hall, 71 Main Street, Dechmont EH52 6LJ which it occupies under the terms and conditions of a lease with the management.
Regulation
- Giggles and More Ltd is registered with care Inspectorate and operates in compliance with applicable law and regulation. Inspectors regularly visit Giggles and More Ltd to ensure the appropriate standards of care are being provided.
- Giggles and More Ltd is also registered with the Scottish Social Services Council (SSSC) and operates in compliance with the applicable law and regulation.
Fees
- The fees payable in respect of your child/ children’s place at Giggles and More Ltd are set out in the enrollment details.
- All fees are payable monthly in advance, within 7 days of the delivery of an invoice.
- In the event that any fees are unpaid for more than 7 days, we reserve the right to exclude your child from Giggles and More Ltd temporarily until such fees are paid in full.
- Further, we may charge interest on any unpaid fees at a rate of 4% per year, payable from the due date until settlement of any invoice in full.
- In the event that you request any additional attendance for your child during a month, it may be provided subject to availability, and it will be invoiced in arrears.
- Fees are determined on the basis of your bookings, and not attendance. No refund or credit will be provided for sessions missed due to ill health or otherwise.
- We reserve the right to increase fees at any time by providing one months’ notice in writing.
- Upon registration, a non-refundable payment of £35 is needed to secure your child’s place at Giggles and More Ltd Breakfast and Afterschool Club.
Term and Termination
- This contract shall commence on the date of signature, on the child’s first day at Giggles and More Breakfast and Afterschool Club, whichever shall take place first.
- If you booked online or over the telephone, you have a legal right to change your mind about this contract within 14 days of the date of confirmation. You cannot cancel your bookings once your child has started attendance.
- If you change your mind about a booking, you made online or by telephone within 14 days of booking it, and without your child’s attendance starting, please contact us. We will refund you as soon as possible the method you use for payment. We don’t charge a fee for the refund.
- If you wish to withdraw your child from Giggles and More Breakfast and Afterschool Club, you must provide no less than 4 weeks’ written notice. If you would prefer to withdraw your child immediately, you will still need to pay the fees in full during this notice period.
- If you wish to increase or decrease your child’s attendance, we will also need 4 weeks’ written notice. In the event that we are able to facilitate an increase in attendance in less than 4 weeks, we shall, subject to payment of the amended fees.
- We reserve the right to suspend or terminate care of any child without notice, where we reasonably consider it to be necessary for the overall safety and well-being of staff and children in our care.
- We may terminate this contract for any reason by providing no less than 4 weeks’ written notice.
Operating Hours
- Giggles and More Ltd operates from 7: 30 am for Breakfast Club until school drop-off and until 18:00. During school hours, we are open from 07:30 am until 18:00. This does not include any bank or public holidays.
- Please inform us immediately if you will be late collecting your child. Any collection after 18:00 will incur a fee of £10 per 15 minutes commenced.
- You must notify the club before the start of the session if you are collecting your child from school. Alternatively, they will attend another club on a day that they are booked to attend Giggles and More Breakfast and Afterschool Club. You will still be required to pay the fees in full for these booked sessions.
- Early drop-off’s may be accommodated provided that they have been agreed in advance.
- The minimum attendance will be 3 sessions per week.
- You must notify Giggles and More Ltd if an unauthorized person will be picking up your child. Verbal or written permission must be received before we will release a child to anyone who is not authorized on the registration form. They must bring photographic ID, plus a photograph to be kept on file and a password will be used.
Illness and Medical Needs
- The parent agrees that it is their accountability to
- Notify Giggles and More Ltd as soon as possible if your child has a contagious illness. You should observe the exclusion period for infection control issued by Public Health England.
- You should keep Giggles and More Ltd informed of any alterations to the child’s information, which includes medical conditions and dietary needs.
- The Parent agrees that, in the event of an accident or incident, Giggles and More Ltd may provide first aid treatment, and if needed, authorise any urgent medical treatment if we cannot reach the parent promptly.
- The parent understands and agrees that, while information regarding their child will be treated with confidentiality. In certain circumstances, Giggles and More Ltd will be obliged by applicable law or regulation to share information about the child to other organisations, including the police, social care, and healthcare professionals.
Data Protection
- Giggles and More Ltd shall treat any personal information related to the parent and child in accordance with applicable law and regulation, as set out in its privacy policy.
- No photographs or video images shall be permitted to be taken at Giggles and More Ltd, other than in accordance with the privacy policy.

- We operate in compliance with the following policies, copies of which are available to you upon written request. It is your responsibility to familiarise yourself with the contents of the policies.

Ancillary Matters
- Any notice given to a party under or in connection with this contract shall be in written and shall be
- Delivered by hand or by pre-paid first-class post or other working day delivery service at its registered office (if a company) or the address first noted above (for an individual).
- Sent by email to the address specified above.
- Any notice shall be deemed to have been received
- If delivered by hand, at the time the notice is left at the proper address
- If sent by next working day delivery service, ay 9am on the second business ay after posting, or
- If sent by email, at the time of transmission, or if this time falls outside business hours in the place of receipt, when business hours resume. Business hours mean 9 am to 6 pm, Monday to Friday on a day that is not a public holiday on the place of receipt.
- This notice provision does not apply to the service of any proceedings or other documents in any legal action, or whenever applicable, any arbitration or other method of dispute resolution.
- A person who is not a party to this contract shall not have any rights under the Contracts (Rights of Third parties) Act 1999 to enforce any term of this contract.
- This document constitutes the entirety of the agreement between parties. It exceeds any prior representations which may have been made, be it orally or writing. Any modifications to this contract must be made in writing and signed by both parties.
- No failures or delay by a party to exercise any right or remedy provided under this contract or by law shall constitute a weaver of that or any other right or remedy. It shall never prevent or restrict further exercise of that aspect. No single or partial excuse of such right or remedy shall prevent or restrict the further exercise of that or any other right or remedy.
- All clauses, sub-clauses, and parts thereof shall be severable and will be read and constructed independently. Should any part of this agreement be found invalid this will not affect the validity or enforceability of any other provision or of this contract as a whole.
- This contract, and the rights set out in it must not be assigned or renewed by the parent. Giggles and More Ltd may assign or novate this contract as required, by giving written notice to the Parent.
- This contract and any dispute or claim arising out or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed and constructed a per the law of England and Wales.
- Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with the contract or its subject matter or formation (including non-contractual disputes or claims).
I have read and understood the terms and conditions, and I agree to be bound by them and any other relevant booking terms and conditions that are issued from time to time.
